Just go on iTunes and download it? It'll say whether you need to update or not on the iPod Touch screen thingy.

i have the 2nd generation i think bcuz i have built in speakers that play music without headphones and i think its at the 2. somthing update. I want the 3.1 one can you help?

Uhmm... 1st generation doesn't have built in speakers... if you want 3.1 what's yours at now? 2nd does. 3rd gen came out like a couple of months ago.
