Stanley Cup rioter with no prior criminal record jailed

A 20-year-old Surrey man with no prior criminal record has been sentenced to one month in jail for his role in Vancouver's Stanley Cup riot.

Emmanuel Alviar, who pleaded guilty in March to mischief and participating in a riot, was also given 16 months' probation and ordered to write apology letters to Mayor Gregor Robertson and Police Chief Jim Chu in Vancouver provincial court Monday.

The court heard that the choir singer had been in charge of four 14-year-olds when he joined in the destructive mayhem of June 15, 2011, and was filmed overturning a police car and throwing a barricade into a store window.

Judge Reg Harris gave Alviar credit for turning himself in to police early in their investigation and showing remorse for his actions, but said there clearly exists "a large group of persons" willing to join in a riot should the opportunity present itself, and they must be discouraged from doing so.

"The need for substantial deterrents is borne out by the size of the riot, the duration of the riot, the harm caused by the riot and, significantly, that this is the second time Vancouver has experienced a hockey-associated riot," Harris said.

The fact that Alviar was seen rioting at three separate locations over a period of several hours was also taken as an aggravating factor.

The young man was visibly surprised Monday after the sentence was handed down, and shook his head before being led away with his hands cuffed behind his back.

Alviar offered an apology to the city during a May appearance in Vancouver provincial court, admitting that "instead of trying to keep the peace, I added to the chaos."

His lawyer Gary Botting told reporters outside the courthouse that his client had not been expecting to go to jail, and that a conditional sentence would have been more appropriate given his clean record.

Though Crown prosecutors had asked for a four-month sentence, spokeswoman Samantha Hume said they were satisfied with the outcome of the trial.

"He will be serving at least several weeks in jail, and that indeed is a real jail sentence for someone who has never been involved in the criminal justice system," Hume said.

In February, another 20-year-old, Ryan Dickinson, was given 17 months in jail for his role in the riot.

Like Alviar, the young man pleaded guilty and admitted to vandalizing a police car and a business, but Dickinson had a prior conviction on his record.

He received 16 months for participating in a riot and another month for breaching his bail conditions from an unrelated assault charge.

Police have recommended 592 criminal charges against 200 suspected rioters so far. Of those, 238 counts have been approved against 91 suspects.

Wait.. I mean, oh no, a criminal didn't expect to be sentenced upon being found guilty.. the charges should just be dropped.

He was a choir boy 6 years past.. choir boys are innocent even when guilty.

He obviously is religious, in the eyes of religion as long as you believe you're doing the right thing even when you frack up and commit heinous acts, it should just be overlooked. There's no need to act civil and follow the law, Christ would hate that, what are you thinking, court?

Didn't you guys see? There were other people doing it.. they were the ones at fault for him overturning police cars, breaking windows, and participating in a riot. Charge them! He's just an innocent boy, he just turned the cars over to rub their bellies or perform auto CPR, and broke windows to save ten children from a burning fire! He's a choir boy for Christ's sake!

The way some of these morons try and avoid taking responsibility for the choices they make is nothing short of hilarious. Throw the mother fracker in jail.

Considering while he was being led away in cuffs he muttered "this is crazy", he still doesn't get what he did was wrong in my opinion. Hopefully a little jail time will help him "get it"

I think he should have received some community service as well. Oh well, its a good start. Hopefully the thought of jail time will deter future rioters when the Canucks get back to the finals.
