That the system can work in the favor of defendants that happen to have deep pockets exposes the same flaw.

Those with deep pockets or some other access to legal help such that cost is not a concern can use that to leverage power not available to those without.

Even if you did have the chance of winning all your legal fees back if confronted with the threat of being taken to a tribunal that risk alone would put a lot of leverage on the complainant to push their own agenda. Bullying at it's finest.
