I haven't seen anything from mpt or D&D saying Backman is off limits, so I think he's fair game.

I traded Backman to San Jose in the Rose trade, he was unable to sign him. I would assume he is fair game.

Ideally I'd like Backman to return to San Jose as he had all the intention to sign him; but I can't say it's mandatory. Sometimes players don't sign; like Doughty did for Philly, Hall for Edmonton and Thornton did for me.
