Obvious is obvious. It's just if a person is going to start something, it seems a little cowardly not to finish it, is all. C'est la vie, you've made it clear where your sentiments lie.


Hope this mother gets some sort of justice for her daughter as toughing out years of bullying from schoolmates is not a viable or healthy option.

I understand this is an issue, but why is this a news story?

Can't the parties involved deal with this behind closed doors or something? Seriously, this is not news.

Flame on, sensitive people!


Because, sadly, public shaming of schools seems to be the only way to force them to take responsibility for providing a safe learning environment instead of fostering poor behaviour.

In my experience the girl with the biggest boobs also got bullied the least.

I suppose if a child had a cleft palate they'd be told to get plastic surgery to avoid bullying? If a child was born missing a part of a limb they'd be told to get a prosthesis to avoid bullying? If a child came to school with a lisp parents would be told to take them to speech therapy to avoid bullying? All things someone is born with and cannot help........just like the child in this story. The crass stupidity of these (this?) school official is appalling.

And I don't for one nano-second believe that there was "miscommunication" involved at all.


And if the child was black they tell them to have pigment surgery.

What is up with these American schools??

Not all that different from Canadian schools as noted in the "Students try to shut down strip club" thread. And remember the Amanda Todd case?

How about the case of the bullied North Van student who had to take his fight to the BC Human Rights Tribunal and the courts when the school did not act? It went to the BC Court of Appeal - North Vancouver School Dist. No. 44 v. Jubran (2005), 52 C.H.R.R. D/1, 2005 BCCA 201

The Court of Appeal agreed with the Tribunal, finding that Mr. Jubran's complaint fell within the ambit of the Code. The harassment was persistent, homophobic in nature, and negatively affected his high school educational experience.


It is common ground that a person who is perceived to have characteristics that are protected by human rights legislation, such as being disabled, is protected from discrimination on that account, whether he is in fact disabled or not. But in this case, requiring Mr. Jubran to show that his harassers believed him to be homosexual is akin to requiring him to prove that they intended to discriminate against him. The effect of the actions of Mr. Jubran's harassers was that he was discriminated against because of sexual orientation, whether they believed him to be homosexual or not.


It imposes an unwarranted burden on a person such as Mr. Jubran, the Court of Appeal wrote, to require him to either declare himself as a homosexual or to prove that his harassers believed him to be homosexual. The emphasis should be placed on the effects of the homophobic taunts, not on the intentions and beliefs of the harassers.


The Court of Appeal also found that the Tribunal's decision regarding the liability of the School District was sound. The Tribunal's conclusion that the School District has a responsibility to foster a discrimination-free school environment was comparable to the Supreme Court of Canada's decision in Canada (Treasury Board) v. Robichaud that an employer has a responsibility to provide a healthy work environment.

The Court of Appeal allowed the appeal, and restored the order of the Tribunal. It also awarded costs to Mr. Jubran.


The major problem with schools is that they are staffed and administered by teachers. ::D
