Actually, Bethesda's tactics on this game are even slimier than you can imagine (something EA would be proud of ). For the first time in a long time (at least to my knowledge), Bethesda didn't distribute the game via steam (as that method allows you for a refund if the product isn't really in a playable state):

HOWEVER, Bethesda's policy is (at least with respect to this game): If you download it, tough ****. No refunds. (only way to get game is via download from them as even if you buy the "collectors edition", the DVD jewel cases are empty (eg., you still have to download the game from them). They did this as they had to know game was not playable at the launch date (you can argue it still isn't).
It often takes years and/or a number of games to build up a reputation but it only takes one cash grab to destroy it.
