If you accepted the phone and have been using it then you have already agreed in principle to the contract. They can't nail you on the fine print stuff if you didn't sign, but the basics like paying monthly, term length, fees for cancelling will all still apply.
You can't argue you didn't want the contract if you took the phone and the service, you will get torn apart in court.

This is why contracts must have consideration on both sides, that way you can determine someone's willingness to engage in the deal by whether or not they accepted the consideration.
In this case, the consideration for you is the phone and plan, if you accept those, under the law you have accepted the deal.
