Oh, It Gets Better... Lupul, Phaneuf and Cuthbert all Suing TSN for tweet put on-air

TSN was incredibly stupid, but I think the apology is enough.

There are at least a couple of Issues with that viewpoint.

1. Are there people out there still wondering if the there is some truth behind the tweet?

If there is anybody in that situation, then damage has been done to the reputations of the people who were defamed and they are entitled to be compensated for that.

2. If TSN gains viewers and accordingly advertising revenue by running this racy sort of rumour, then without sufficient monetary cost there is nothing to keep TSN from gaining by doing it.

There's a difference between making a ill-conceived "joke" on Twitter and having it seen by all five of your followers and having a TV show watched by millions show it on air.

This was a complete snafu by TSN and completely deserving of the reaction it got from Phaneuf and Lupul.

You are a serious speech Nazi. It's a joke. Rude and crude, but definitely undeserving of a civil suit.

Get ready to have every comedian and late night talk show host sued to infinity for making jokes, because that's what you are advocating.

It's not free speech if we are only permitted to say what's politically correct.

What is free speech?

Is it allowed in schools or hockey arenas, (pro or minor) or on TV and other media?

Defamation is not legal.

Slander is not legal.

Hate speak is not legal.

Are you advocating a race to the bottom?

What Avery said wasn't necessarily 'false'. It was derogatory, poor taste, etc., but not slander.

Lesson learned: any time you want to chirp a player over twitter throw the word "allegedly" in there to leave it open to speculation instead of a statement of fact.

I'd feel better punching that douchbag square in the face than go through countless hours dealing with a lawsuit that might not work out in your favor.

Cause as a rich hockey player in a prominent hockey market you want to be punching fans in the face for lame tweets. Cause it's better to pay them money from the impending assault charges from the punch that crippled them, rather than being a mature adult. :rolleyes:

It was an inside joke between his friends. It wasn't meant for Phaneuf, Lupul and Elisha to even read. Things like that get said on twitter all the time. Justin Bieber may as well sue every one of his haters that trash him on twitter if this guy is getting sued.

 

Publishing something on Twitter is putting it out in public, especially when you give it a TSN hashtage; therefore it is no longer an inside joke. Once something is published on social media it is no longer private. People posting stuff like this on Twitter and Facebook need to read up on liable and slander law.
