How is that in any way related?

Some dude who finds Christmas offensive shouldn't be forced to put up decorations for it, and have his job threatened if he doesn't. That's a perfectly reasonable ruling.

Whereas choosing to go eat in a restaurant, and taking offense to an optional item on the menu, is easily fixed. Eat somewhere else, or stop being so sensitive. This is OBVIOUSLY just a money grab.


It is related because it shows how ridiculous some of the Human Rights Tribunal decisions are. When this ruling came out it was widely panned. Most people thought it was a bizarre ruling.

I don't know about you, but when my boss ask me to do something, I do it. I don't ask why or argue with him.

Where does that reasoning end though?

What if a Sikh guy has worked at a place for 16 years, then suddenly the new boss decides he doesn't like turbans, and that him wearing it hurts business. Can he force him to take it off, or be fired?

What if you work in the bible belt of the Fraser Valley, and your pro-life boss decides that he wants to advertise that stance at work, and feels that it will help attract business. Meanwhile, you're pro-choice, and feel strongly. What do you do?

And what about sexual harassment? Obviously, "when my boss ask me to do something, I do it" is not the be-all, end-all.

That characterization is inaccurate.

There was no decision reached by the BCHRT on the substantive issues of complaint. In December the BCHRT ruled there were sufficient grounds to proceed with a hearing on application for Earl's to dismiss. The test applied to dismiss is that there is no reasonable prospect that the complaint would succeed.

[57] I find, on all of the material filed, that I am not able to conclude that there is no reasonable prospect the Complainants would succeed in their s. 7(1)(a) complaint. This complaint requires finding of facts at a hearing with all of its safeguards. Earl’s’ application to dismiss the s. 7(1)(a) complaint under s. 27(1)© is dismissed.

[62] I have not been persuaded that there is no reasonable prospect that the Complainants would succeed in their s. 8(1)(b) complaint. Earl’s’ application is dismissed.

...

[68] I have not dismissed the complaints under s. 27(1)©, as the Complainants have convinced me, on the material filed, that their Complaint is beyond the realm of conjecture, and I was not persuaded by Earl’s that there was no reasonable prospect that it would succeed. I cannot see how it would offend the purposes of the Code to proceed in these circumstances, where there is no other information about the resolution of the complaint.

[69] Earl’s’ application to dismiss the complaints under s. 27(1)(d)(ii) is dismissed.

VI CONCLUSION


[70] The Respondents’ application to dismiss is denied on all grounds argued.

Earl's decided to remove the brand prior to the hearing on the merits. Per the press release:

Earls Restaurants Ltd. has chosen to remove the word “albino” from all of our products and marketing in response to a human rights complaint by a group of persons with the condition of albinism. The change to the menus in all our restaurants will be completed by April 24, 2013.


The Albino Rhino brand was created 25 years ago and named after the white rhinoceros. It did not occur to us that the name would be associated with albinism, neither did it occur to us it would offend. We do not believe the use of the word “albino” reflects any intention to discriminate against persons with albinism. We have learned from participating in the human rights complaint process, however, that many persons with albinism are genuinely offended and feel that their dignity is negatively impacted by the use of the word “albino” in our marketing. Albinism is a very rare condition and like many Canadians we knew very little about the condition or the very real discrimination persons with albinism experience, both in Canada and around the world. Persons with albinism are a stigmatized group that face prejudice and exclusion in many areas of Canadian society.


Although we did not agree with the complaint, Earls wishes all members of the public to feel welcome at our restaurants and, accordingly, we no longer feel it is appropriate to use the word “albino” as part of our marketing.
