So I think you could get away with saying something offensive but if you continued to persistently go at someone you could fall under the purview of C16. Sure you can toss insults and likely nothing will happen but at the end of the day hate speech is illegal. There's already laws for that and it doesn't include just trans people, it's for everyone! (How inclusive!). It's redundant law. I believe the language issue is deciding what exactly defines 'harassment'. Does accidentally calling someone him/her when they identify as 'other' constitute 'harassment'.
