Rule 40 – Physical Abuse of Officials

40.1 Game Misconduct - Any player who deliberately applies physical
force in any manner against an official, in any manner attempts to
injure an official, physically demeans, or deliberately applies physical
force to an official solely for the purpose of getting free of such an
official during or immediately following an altercation shall receive a
game misconduct penalty. In addition, the following (40.2, 40.3, 40.4)
disciplinary penalties shall apply.

40.2 Automatic Suspension – Category I - Any player who deliberately
strikes an official and causes injury or who deliberately applies
physical force in any manner against an official with intent to injure, or
who in any manner attempts to injure an official shall be automatically
suspended for not less than twenty (20) games. (For the purpose of
the rule, “intent to injure” shall mean any physical force which a player
knew or should have known could reasonably be expected to cause
injury.)

40.3 Automatic Suspension – Category II - Any player who deliberately
applies physical force to an official in any manner (excluding actions
as set out in Category I), which physical force is applied without intent               <--- This one.
to injure, or who spits on an official, shall be automatically suspended
for not less than ten (10) games.

40.4 Automatic Suspension – Category III - Any player who, by his
actions, physically demeans an official or physically threatens an
official by (but not limited to) throwing a stick or any other piece of
equipment or object at or in the general direction of an official,
shooting the puck at or in the general direction of an official, spitting at
or in the general direction of an official, or who deliberately applies
physical force to an official solely for the purpose of getting free of
such an official during or immediately following an altercation shall be
suspended for not less than three (3) games.

40.5 Automatic Suspension – Process - Immediately after the game in
which such game misconduct penalty is imposed, the Referees shall,
in consultation with the Linesmen, decide the category of the offense.
They shall make a verbal report to the League’s Director of Hockey
Operations and advise of the category and of the offense. In addition,
they shall file a written report to the Director of Hockey Operations in
which they may request a review as to the adequacy of the
suspension. The NHLPA, the player and the Club involved shall be
notified of the decision of the Referees on the morning following the
game. The League will then hold a conference call with the NHLPA to
review the Referees application of this rule, and will refrain from
issuing public comment affirming the Referees application of Rule 40
until that call is complete.

The player or the officials may request the Commissioner to
review, subject to the provisions of this rule, the penalty imposed by
the Referees. Such request must be filed with the Commissioner in
writing not later than seventy-two (72) hours following notification of
the penalty.

If a review of the incident is requested by either the player or by
the officials, a hearing will be conducted by the Commissioner on an
expedited basis, and best efforts will be used to provide a hearing
before the second game missed by the player due to the automatic
suspension imposed under this rule. The player’s suspension shall
continue pending the outcome of the hearing by the Commissioner.
For Category III offenses only, the Commissioner may conduct the
hearing by telephone. For Category I and II offenses, the hearing shall
be conducted in person.

After any review as called for hereby, the Commissioner shall
issue an order that:
(i) sustaining the minimum suspension, or
(ii) increasing the number of games within the category, or
(iii) changing to a lower category, or
(iv) changing to a lower category and increasing the number of games
within this category, or
(v) in the case of a Category III suspension only, reducing the number of
games of the suspension.

The penalties imposed under this rule shall not be deemed to limit
the right of the Commissioner with respect to any action that he might
otherwise take pursuant to Article 18 of the CBA

I would guess that he gets 10 games for this.

it's unfortunate because the linesman got too involved in the play and should've just let them go.. you know Engelland was laughing his a$$ off about it, maybe he should've been ejected as well..

Kane can be a game changer if he could just hold it together. his first season in SJ, he put up points and was very effective.. then he had that whole tragic lost baby thing and maybe that was a catalyst but it seems like his anger is getting the best of him. teams know he has a short fuse, so they target him..

as the most penalized player in the league, maybe the refs are targeting him too, and now he will likely have the league after him..

I am glad he's not in blue & green..

Engelland also got ejected but there was less than 8 min to go.

I understand why Kane was angry about the linesman.  While the context of the game seemed to be that temperatures were already super elevated by that point, the linesman took preemptive action chasing Kane and grabbing him from behind.  It honestly couldn't have been something any player would have expected and it could have been dangerous.

I understand why the officials made the call however.  They obviously want to dissuade players from shoving them, however lightly.

That being said, aside from the accidental slash (which was bad and could have been called), Kane's shove did not seem like much at all.

There's plenty of blame to go around here and I think it would be unjust to apply the auto suspension to Kane.  The refs should have called the slash.  That should have been the end of it.

10 games is heavy but it is the minimum. They can't give him less.

You. Can't. Touch. A. Ref.

You file a complaint if you feel slighted and hope for the best. If we start letting players shove refs at all, the game of hockey would become a joke.

Now that said, what the hell was the Zebra thinking. Bad day at the office bud, try not to make the game about yourself. He had too much enthusiasm going after Kane like that.

San Jose Sharks forward Evander Kane was ejected from the team’s final preseason game against the Vegas Golden Knights for an abuse of officials infraction.

The incident occurred at the 12:51 mark of the third period when Kane became involved in an altercation with Golden Knights defenceman Deryk Engelland.  A linesman separates the two players and knocks Kane to the ice in the process, when the two get up, Kane appears to shove the official in the chest.

Kane was assessed a 10-minute misconduct and a game misconduct on the play.

Engelland picked up a cross-checking minor and a misconduct.

Earlier in the game the 28-year-old also picked up a roughing minor and a fighting major for battles with Golden Knights forward Valentin Zykov.

Kane finished the game with an assist and 27 minutes in penalties.

Who wanted this guy again?  Thank your lucky stars he isn't a member of this team.

Happy he isn't a Canuck. Good fantasy draft pick though.. lol

The officials are already a joke.  Complaining got Burrows' character assassinated by Rotten Ronnie on national TV.  Maybe if MacEwen shoved Sutherland a few times and told him that more was coming if he didn't clean up his act, he'd think twice about rigging Canucks games.  Professionalism isn't causing the refs to conduct themselves appropriately, so maybe fear might be an acceptable option until the NHL actually starts holding them accountable.  Hell, it worked in the Summit Series with JP Parise.  I don't like it, but the NHL is entirely responsible for allowing officiating to deteriorate to this level.
