You need a blood or breathalyzer test to confirm it yes?

Not at all… that is for the police and proving criminal charges.

 

The NHL and arbitration doesn’t have the same burden of proof.

 

They just have to prove that it is slightly more likely than not (on the balance of probabilities = 50.001% chance) that the incident stemmed from a substance abuse problem.
